VideoFloppy provides an online video sharing service (the "Service", the "VideoFloppy"). VideoFloppy offers access to the components of the Service free of charge.

These Terms of Service are an agreement between you and VideoFloppy regarding your use of the Service. VideoFloppy provides the Service subject to these Terms of Service.

We reserve the sole right at our legal discretion to modify or change the below stated Terms and Conditions, at any time, which is offered. You will find that the most current version of the Terms and Conditions will supersede any and all previous versions. Furthermore, it is your legal obligation to review and acknowledge both the usage of the Site and Terms and Conditions carefully and upon acceptance of all the terms set forth.

VideoFloppy reserves the right to remove any Videos that compromise the security of the server, use excess bandwidth, or are otherwise malignant.

The following types of videos may not be shared under any circumstances:

Videos that infringe on the copyrights of any entity.
Videos that are illegal and/or in violation of any laws.
Pornography or child pornography, sexually explicit postings and/or content;
Promotions dealing with escort services, dating services, illegal goods, illegal drugs and/or actions relating to any terrorist activities;
Materials that illustrate any hatred towards others that may or may not be slanderous, grossly offensive, expressions of prejudice or lewd blatant profanity that involves violence, harassing, bullying and otherwise objectionable content;
Services that result in spamming and/or any pyramid schemes or gambling;
Posts that promote instructions to encourage destructive or illegal actions against any governments, organizations or law enforcement agencies;
Content that introduces the use of any harmful viruses, codes and/or trojan.
Therefore, you agree that you will not violate any of the above provisions or additional provisions from time to time added by VideoFloppy and hold us liable for any illegal or prohibited content. In case you are found to be in violation of any prohibited content that contradicts our policies and/or even results into any criminal or civil laws violation, you will be subjected to be disbarred and removed from the Site and reported to all local and international authorities within but not limited to the jurisdictions of VideoFloppy, or any other jurisdiction that considers any cross-border criminal act to be prosecuted. We will not hesitate to provide data and work closely with any authority in the act of good faith to bring justice. You may also contact us in case you consider any activity to be illegal or in any such violation of our policy with prohibited content.

Terms of Usage

VideoFloppy assumes no liability for lost or corrupt links, files or misplaced file URLs.

It is user's responsibility to keep track of this information. You acknowledge and agree that you are solely responsible for the content that you upload, store or share with others using the Service (collectively "User Content"), and for the consequences of uploading, storing or sharing any User Content.

Spam Policy

We do not allow any spam. Furthermore, VideoFloppy reserves the legal right to prosecute for this violation, which may result in monetary civil fines, including, but not limited to criminal sanctions.

Advertising

Advertising served by VideoFloppy itself or by VideoFloppy in cooperation with a third party ("VideoFloppy Advertising") may appear on the VideoFloppy website or in communications sent by VideoFloppy. You understand and agree that all revenue resulting from VideoFloppy Advertising will be paid exclusively to VideoFloppy, and that you have no right or interest in any such revenue. You understand that VideoFloppy is not responsible for the textual, visual, technological features or the content of advertisements that appear on the VideoFloppy website or in VideoFloppy communications, other than advertisements created and served directly by VideoFloppy (if any). By using the Service, you agree that VideoFloppy will not be liable for any VideoFloppy Advertising that it does not create and serve. Limitation of Warranties or Guarantees and Limitation of Liability

VideoFloppy DOES NOT GUARANTEE THE ACCURACY, RELIABILITY, COMPLETENESS, OR TIMELINESS OF THE SERVICE OR OF ANY CONTENT MADE AVAILABLE THROUGH THE SERVICE. In particular, and without limitation, VideoFloppy gives no warranty or guarantee that: (1) the Service will meet your requirements; (2) the Service will be uninterrupted, timely, secure, or error-free; (3) the results that may be obtained from the use of the Service will be accurate or reliable; (4) the quality of any products, services, information or other material obtained by you through the Service will meet your expectations; (5) any errors in the components or contents of the Service will be corrected; or (6) that the Service is free of viruses or other harmful components. YOU UNDERSTAND AND AGREE THAT VideoFloppy WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, PUNITIVE OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, INTEREST OR APPRECIATION, LOSS OF GOODWILL, OR HARM TO REPUTATION, OR FOR ANY INTANGIBLE LOSSES RESULTING FROM THE USE OF OR THE INABILITY TO USE THE SERVICE OR ANY DATA UPLOADED, STORED OR MADE AVAILABLE THROUGH THE SERVICE, WHETHER OR NOT VideoFloppy HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN ANY EVENT, YOU UNDERSTAND AND AGREE THAT THE MAXIMUM LIABILITY OF VideoFloppy ARISING FROM OR RELATING TO YOUR USE OF THE SERVICE WILL NOT EXCEED THE AMOUNT PAID BY YOU TO VideoFloppy, OR OWED BY VideoFloppy TO YOU, PURSUANT TO THESE TERMS OF SERVICE AND THE OTHER TERMS AND CONDITIONS THEY INCORPORATE. Some jurisdictions do not allow the exclusion of certain warranties or the limitation or exclusion of liability for incidental or consequential damages. Accordingly, some of the limitations on liability and damages set forth above may not apply to you.
